1. Introduction

These Terms and Conditions ("Terms") govern your use of This is Your Life ("the Service"), a digital memorial and family archive platform. By creating or viewing a memorial page, you agree to these Terms.

2. Definitions

  • "Memorial" — a digital memorial page created on the Service for a deceased or pre-planning individual.
  • "Page Creator" — the person who creates and manages a Memorial.
  • "Contributor" — a person who adds memories, photos, or other content to a Memorial.
  • "Content" — any text, images, audio, video, or other material uploaded to the Service.
  • "Subject" — the person whose life is commemorated by a Memorial.

3. Accounts & Access

  • You may create a Memorial without an account. An email address is required for ongoing access and notifications.
  • Memorial owners can invite others as shared editors.
  • You are responsible for maintaining the confidentiality of any access credentials.

4. Memorial Pages

4.1 Ownership & Control

  • The Page Creator controls the Memorial and its settings, including privacy, content approval, and publication.
  • The Service does not own the Content; creators retain ownership. By uploading, you grant the Service a licence to host and display the Content (see Section 5).
  • If a subscription lapses, the Memorial will remain viewable but read-only until payment is restored.

4.2 Deceased Subject

  • By creating a Memorial, you represent that you have the right to do so, including consent from the Subject's family or estate where applicable.
  • We reserve the right to remove Content that is defamatory, offensive, or brought to our attention by a legitimate legal claim.

5. User-Generated Content

5.1 Licence

You grant This is Your Life a non-exclusive, royalty-free licence to host, store, display, and process your Content as necessary to operate the Service.

5.2 Responsibility

  • You are solely responsible for the Content you upload.
  • You must have the rights to any photos, videos, or text you upload.
  • You must not upload Content that is illegal, defamatory, infringing, or harmful.

5.3 Moderation

  • All community contributions (memories, photos, tributes) are held in a pending queue and approved by the Page Creator before appearing publicly.
  • We reserve the right to remove any Content that violates these Terms.

6. Acceptable Use

You agree not to:

  • Upload Content that is unlawful, defamatory, harassing, or infringes intellectual property rights.
  • Use the Service to send unsolicited communications.
  • Attempt to gain unauthorised access to the Service or its systems.
  • Scrape, copy, or redistribute Content from other users' Memorials without permission.
  • Create Memorials for fictitious individuals with intent to deceive.

7. Plans, Pricing & Payment

7.1 Plans

  • Self-Service (£30 setup + £3/month): Guided page builder with up to 100 photographs.
  • Done-for-You (£149 setup + £3/month): We build the page for you, with up to 500 photographs and up to 30 minutes of video.
  • Pre-Plan (£30 setup + £3/month): Create your own memorial in advance.
  • Free: Gifted memorials with up to 50 photographs and no video.

7.2 Subscription

  • The monthly hosting fee (£3/month) maintains the Memorial online indefinitely.
  • Subscription payments are processed securely by Base44 Payments (powered by Wix).
  • If a subscription is cancelled, the Memorial becomes read-only but remains online.

7.3 Refunds

  • Setup fees are non-refundable once the Memorial creation process has begun.
  • Monthly subscription fees are non-refundable for the current billing period but can be cancelled at any time.

8. Storage Limits & Fair Use

  • Storage limits are defined per plan (see Section 7.1).
  • All plans have defined limits to ensure sustainable long-term hosting.
  • We may offer additional storage for an additional fee.
  • We reserve the right to apply fair usage policies to prevent abuse.

9. Data Retention & Memorial Duration

  • Memorials are designed to remain online indefinitely, subject to active subscription.
  • Content is stored for the lifetime of the Memorial.
  • If a subscription lapses for more than 12 months, we will attempt to contact the Page Creator before making any changes to the Memorial's Content.

10. Privacy & Data Protection

Your privacy is important to us. Please see our separate Privacy Policy for details on how we collect, use, and protect your data.

11. Intellectual Property

  • The Service, including its design, software, and branding, is owned by This is Your Life and protected by intellectual property laws.
  • User Content remains the property of the respective creators.

12. Disclaimers & Limitation of Liability

  • The Service is provided "as is" without warranties of any kind.
  • We do not guarantee that the Service will be uninterrupted or error-free.
  • To the maximum extent permitted by law, we shall not be liable for indirect, incidental, or consequential damages.
  • Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

13. Changes to These Terms

  • We may update these Terms from time to time.
  • Material changes will be notified to Memorial owners via email.
  • Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
  • A version history with summaries of changes is available on this page.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
